Terms
Draft v0.1 (September 22, 2026)
1. Parties and authority
The buyer orders for the named company and confirms authority to bind it. The service is business-to-business only and is not offered to consumers or homeowners for personal use.
2. Service
BeforeCrew records only the observations listed in the accepted request: a reference capture of the stated work zone, indexed photos, access facts, visible obstructions, any requested measured points, and open questions. BeforeCrew does not investigate concealed conditions or infer what cannot be safely observed.
3. Buyer instructions and tolerancesCounsel review
For any measured point, the buyer identifies the point, datum, unit, and tolerance class. If no tolerance class is supplied, the item is marked reference only and may not be used for a fit-dependent decision. The reference capture is delivered as a reference only.
4. Limited purpose
The pack is preliminary field intelligence for the specific quote, access, or planning decision named in the order. It is not architecture, engineering, land surveying, design, code, permit, shop-drawing, or inspection services, and it is not a construction or fabrication document.
5. No final reliance
The buyer will not fabricate, cut, order final-size material, release shop drawings, obtain permits, establish code compliance, direct construction, or verify life-safety or structural conditions from the pack. The buyer's qualified team independently verifies every consequential condition.
6. Observation limitsCounsel review
Observations may be affected by access, finishes, obstructions, lighting, instrument limits, human error, or later change. BeforeCrew identifies known limits and open items in the pack. A tolerance class is the class the buyer selected; it is not a promise that every entry falls within it.
7. Changes and conflicts
The pack reflects visible conditions at the stated time. If entries conflict, a required field is blank, an item is outside scope, or site conditions differ from the request, the buyer stops and asks before using the entry. Later changes to the site are outside the pack.
8. Buyer responsibilities
The buyer provides site authorization from the party in control of the premises, safe and lawful access, accurate background information, any notices to affected parties, and restricted-area warnings. Work may stop when a site is unsafe, inaccessible, unlawful to enter, or outside scope.
9. Ownership and sharingCounsel review
The buyer may share the pack with its employees and project partners for the permitted purpose, with all warnings intact. The buyer may not present the pack as approved for fabrication or construction or remove the no-reliance legend.
10. CorrectionsCounsel review
The buyer reports a suspected documentation error promptly and does not rely on the disputed entry. The first remedy is review, correction, or a return visit.
11. Fees and cancellation
The order states the price, included travel and scope, rescheduling, denied-access fee, cancellation window, taxes, and payment timing. The first failed-access reschedule is included; further reschedules are charged as shown in the order.
12. Risk allocationCounsel review
Warranty disclaimer, damages exclusion, liability cap, indemnity, claim deadline, governing law, venue, attorneys' fees, and insurance language are reserved for New York counsel and are not in force in this draft.
13. Entire agreement and versionCounsel review
The accepted order, the versioned terms, and the delivered pack form the agreement. Conflicting purchase-order boilerplate does not amend it without a signed change.
A printable copy of the terms in force at acceptance is stored with every request and included in the delivered pack.
